The Court of Appeal found the High Court was wrong to strike out a claim over unpaid fees brought by the Claimant firm of solicitors because of alleged exaggeration and inaccurate sums, without hearing any witnesses.

Orientfield Holdings Ltd v Bird & Bird LLP [2015]
The Claimants claim was for damages arising out of an alleged breach of contract and/or negligence relating to the purchase of a property in London where the Defendants had been the Solicitors acting for them in the conveyancing transaction. Contracts had been exchanged, a deposit paid by the buyers of £2.575 million and completion fixed for the 4th April 2011.

King v The Chiltern Dog Rescue & Anor [2015]
The Claimant issued a claim in the Chancery Division for a declaration that his Aunt had made a donatio mortis causa, that her house passed to the Claimant when she died and, as an alternative that he should receive monetary provision from his late Aunt’s Estate under 1 (1) (e) Inheritance (Provision for Family and Dependants) Act 1975.
